Dynamo Dresden Appeals to DFB Federal Court

The Sanctions Against Both Clubs

The Sports Court had sentenced Dynamo Dresden to a fine of 91,200 euros. Hertha BSC had to pay even 152,000 euros according to the ruling. In addition, both teams must develop a joint security concept for upcoming matches and reduce guest contingents. Furthermore, fans will be partially excluded from the next two Dynamo home games. The second game, however, is suspended on probation until summer 2027.

Managing director Stephan Zimmermann justified the step in a club statement. „Nach Rücksprache mit den Gremien haben wir uns bewusst für diesen Schritt entschieden." The club views the partial exclusion of spectators as a collective punishment and had appealed against it. „Dresden sah den Teilausschluss der Zuschauer als Kollektivstrafe an und hatte dagegen Einspruch erhoben." The arguments of the Saxons, however, did not convince the Sports Court. „Die Argumentationen der Sachsen überzeugten das Sportgericht aber nicht."

Criticism of the Proceedings in Frankfurt

Zimmermann also expressed criticism of the course of the previous hearing. „Die Verfahrensweise der Verhandlung in Frankfurt entsprach nicht dem, was wir uns als Verein erhofft hatten." The original hearing before the DFB Sports Court had taken place in Frankfurt. Now, in the next step, the proceedings are to be held at the Federal Court of the German Football Association. „Im nächsten Schritt wird die Verhandlung am Bundesgericht des Deutschen Fußball-Bundes geführt."

Outlook on the DFB Federal Court

The managing director expressed confidence that the club will be heard before the next instance. „Wir sind zuversichtlich, vor dem DFB-Bundesgericht in einer neuen Verhandlungsrunde eine bessere Möglichkeit zu erhalten, Gehör für unsere Argumente zu finden." A date for the hearing before the DFB Federal Court was initially not announced. The two clubs must agree on the reduction of guest contingents and the joint security concept, regardless of the outcome of the ongoing proceedings.

During the incidents on April 4, numerous people were injured. The exact circumstances and the question of the extent to which individual fan groups can be held responsible for the escalation are likely to play a central role in the further proceedings as well. The appeal does not initially change the immediate effect of the partial exclusions at the upcoming home games of Dynamo, unless the ruling is provisionally suspended.
