Gratz acknowledged that overcrowding in correctional facilities and personnel shortages in the enforcement service and specialist services create difficult framework conditions for the prison system and the FTZ in particular. These structural problems have complicated both the work of staff and the care of inmates, the commission head explained.

Regarding the specific trigger for the investigation – the death of the prisoner in Hirtenberg – Gratz said it could have been prevented "mit erheblicher Wahrscheinlichkeit" if recommendations from the internal audit and the Ombudsman Board had been taken up and implemented earlier. Both the internal audit and the Ombudsman Board had already issued corresponding warnings before the incident.

Gratz spoke in this context of "erheblicher Reformbedarf" and emphasized that prison conditions needed "einer markanten Verbesserung." The commission identified systematic deficits in the handling of persons with mental impairments in the prison system as a central finding.

Focus on Forensic-Therapeutic Centers

Justice Minister Sporrer announced that the report would be analyzed immediately. Following this, a "Gesamtstrategie" is to be developed in order to improve the current situation as quickly as possible. There will no longer be "Weiterwurschteln wie bisher," Sporrer said.

The commission consisted of five members and was appointed directly by Sporrer. With the report now available, comprehensive external analyses of the structural conditions in the Austrian prison system are available for the first time, going beyond the individual case in Hirtenberg.

At the center of the criticism is the situation in the forensic-therapeutic centers. These facilities are part of the Austrian prison system and cater to inmates with mental illnesses who require special care. The commission sees particularly urgent need for action here.

Personnel Shortages and Overcrowding

In addition to the FTZ, the report also criticizes general prison conditions. Overcrowding – that is, occupancy of correctional facilities beyond regular capacity – as well as chronic personnel shortages in both the enforcement service and the specialist services shape everyday life in many facilities, according to the report.

At the presentation, Gratz explicitly praised the work of staff under these difficult conditions. At the same time, he made clear that the identified deficiencies cannot be compensated for by the commitment of employees alone. Structural reforms and sufficient personnel are needed.

The report's 78 recommendations cover a broad spectrum. They range from organizational changes and personnel concepts to questions of psychiatric and psychotherapeutic care for inmates. Details of the individual recommendations were not fully disclosed at the press conference.

Overall Strategy of the Ministry of Justice

With the announced overall strategy, the Ministry of Justice is responding to the findings. Sporrer emphasized that the analysis of the report should be carried out quickly in order to initiate concrete measures promptly. What exactly the strategy will look like and what budgetary implications are associated with it initially remained unclear.

The Hirtenberg case had previously already occupied the Ombudsman Board and the internal audit of the Ministry of Justice. Both bodies had issued recommendations that, according to the commission's assessment, were not implemented or not implemented sufficiently. Gratz explicitly pointed to these shortcomings.

Shortcomings Regarding Earlier Recommendations

The commission also had to examine whether the existing structures and processes are suitable for preventing comparable incidents in the future. Its conclusion is clear: Without fundamental reforms and better staffing, the risk of further tragic events cannot be averted.

The report was presented on Monday – an ordinary working day – at the Ministry of Justice in Vienna. It now serves as a basis for further political and professional discussion about the future of the Austrian prison system.
