The Federal Constitutional Court in Karlsruhe has ruled that the prohibition on the distribution, acquisition, and possession of sex dolls with a childlike appearance under Section 184l of the Criminal Code is compatible with the Basic Law and has rejected two constitutional complaints (Ref. 2 BvR 1096/22, 2 BvR 1097/22).

In its decision, which was published in writing on Thursday, the Second Senate dismissed the complaints of two affected individuals who claimed that the criminal provision, which entered into force in 2021, violated their general right of personality. The Karlsruhe judges found: "Insbesondere verletzt sie die Beschwerdeführer nicht in ihrem allgemeinen Persönlichkeitsrecht." The prohibitions did indeed touch upon the scope of protection of the right to sexual self-determination, but did not encroach upon its core area of private life.
