Vienna, 26 August 2026

The Supreme Court of Justice and the Higher Public Prosecutor's Office Vienna have, in submissions to the National Council, expressed clear reservations about the planned Federal Prosecutor's Office Act (BuStAG) and warned of a weakening of judicial independence.

The submissions, which were forwarded to the National Council as part of the legislative process, are predominantly critical. The Higher Public Prosecutor's Office Vienna does identify some positive aspects in the draft of the Federal Prosecutor's Office Act (BuStAG), but compared to the status quo sees a "Gefahr signifikanter Verschlechterungen hinsichtlich der Unabhängigkeit der Entscheidungsfindung in staatsanwaltschaftlichen Angelegenheiten der Gerichtsbarkeit und deren Wahrnehmung in der Öffentlichkeit". With this, the Vienna authority joins a growing list of critical voices from within the judiciary.
