Four-year-old from Austria dies after bathing accident in hotel pool in Milano Marittima

According to initial findings, the girl's family had lunch together shortly beforehand. Afterwards, the mother went to the hotel room with the two older sisters, while the father stayed with the four-year-old in a recreational area of the hotel where children's play facilities had been set up. According to the investigations so far, the father asked his daughter to wait for him and left the area for about ten minutes when he also went to the room.

During this time, according to the surveillance images, the four-year-old made her way from the hotel to the pool area. Footage from the surveillance cameras showed, according to the investigators, how the girl went down the stairs from the hotel to the pool area and reached the access to the swimming pool. „Der weitere Weg ist auf den Kamerabildern jedoch nicht zu sehen“, schreibt die Agentur.

The way to the pool

About ten minutes after the girl had left the play area unnoticed, two hotel guests entered the pool area to go swimming and discovered an unresponsive body in the water. The two hotel guests pulled the child out of the pool and called for help. A doctor, who was also among the hotel guests, immediately began resuscitation measures, which were later continued by the emergency services that had been alerted. Despite these efforts, the girl died a short time later in hospital.

At the time of the incident, the hotel's swimming pool was officially closed, and no lifeguard was on duty. The pool area is shielded from the street by a privacy wall. The water depth in the pool is, according to APA, approximately 70 to 150 centimetres. The public prosecutor's office had the hotel's swimming pool secured and is investigating the exact course of the accident. „Die Staatsanwaltschaft will eine Obduktion anordnen, um die genaue Todesursache zu klären“, berichtet die Agentur weiter.

At the centre of the investigation is the question of whether the pool area was properly secured. „Im Mittelpunkt der Ermittlungen steht nun die Frage, ob der Poolbereich ordnungsgemäß gesichert war“, schreibt APA. The Italian investigators found that the three access gates to the pool should have been locked according to regulations, but were open when checked. „Die Ermittler stellten fest, dass die drei Zugangstore zum Pool nach den Vorschriften hätten verschlossen sein sollen, bei Überprüfung jedoch geöffnet waren“, heißt es in dem Bericht.

It remains unclear so far how the girl got into the water: whether she fell in or got into the pool herself is the subject of the ongoing investigations. „Nach dem Tod eines vierjährigen Mädchens aus Österreich in einem Hotelpool im Badeort Milano Marittima haben die italienischen Behörden Ermittlungen wegen des Verdachts der fahrlässigen Tötung aufgenommen“, schreibt die Agentur unter Verweis auf italienische Behörden. The opening of such proceedings serves initially to clarify the facts of the case and enables those affected to exercise their rights of defence, APA further reports.

According to Italian media, those responsible at the hotel, including the operator or the employee responsible for the pool, but also the child's father, could be included in the investigation proceedings. Whether charges will actually be brought is, according to APA, currently completely open. The autopsy is intended to help reconstruct the final minutes before the accident.

Possible accused parties

The Italian authorities are examining, according to their own statements, whether the pool area was adequately secured and whether safety regulations were complied with. The public prosecutor's office secured the hotel's swimming pool as evidence in order to preserve traces. According to APA information, the accident involves the death of a female child aged four, who was staying at the hotel with her family and was on holiday there.

The news agency APA published the report on 19 July 2026 with the title „Fahrlässige Tötung? – Wende nach Tod von Mädchen (4) im Italien-Urlaub“. The incident is making waves in Austria because it concerns a holiday trip to the Adriatic, one of the most popular destinations for Austrian families during the summer months.

Legally, the case is complex: in Italy, manslaughter can also be prosecuted criminally even if there is no intentional act. The public prosecutor's office will decide, on the basis of the autopsy results and the questioning of hotel staff, the first responders and the family, whether and against whom charges will be brought. Until then, the presumption of innocence applies to all possible accused parties.

Legal classification

The Italian police have now secured the statements of the two hotel guests who pulled the girl out of the water, as well as those of the doctor who provided first aid. The employees of the hotel and the emergency services are also to be questioned in order to reconstruct the sequence of the rescue chain. According to APA, the surveillance cameras so far only show the girl's path to the access of the pool; everything else cannot be seen in the footage.

For the Austrian family, the incident means an unimaginable tragedy. The Foreign Ministry in Vienna is, according to APA information, in contact with the Italian authorities to ensure consular support. The repatriation of the body is currently being prepared, while relatives and a crisis intervention team are also looking after the family.

APA has not published any further details about the hotel itself and its safety standards. Nor is anything known about possible previous complaints about the pool area by Italian authorities. The investigators are now examining whether there had been any indications of safety deficiencies in the past and whether the staff had been adequately trained.

Reactions and consequences

The case evokes memories of earlier bathing accidents in hotel facilities, in which children drowned in unsecured pools. Italian consumer protection organisations have been calling for years for stricter regulations for hotel pools, in particular for child-proof barriers and mandatory bathing supervision even outside official opening hours. Whether the current incident will have political consequences is not yet foreseeable.

The APA report concludes with the finding that investigations have been opened on suspicion of manslaughter. The Italian judiciary will examine the case with the care customary in such proceedings, according to circles within the public prosecutor's office in Ravenna, which is responsible for Milano Marittima.

The Italian tourism industry is responding cautiously to the incident. Industry associations refer to the generally high safety standards in the hotels on the Adriatic coast, but emphasise that each individual case must be examined. The accident is also being discussed on social media, with many users expressing their sympathy for the family.
