German government considers extending sugar tax to diet and mixed beverages

Alois Rainer, the CSU-led Minister of Agriculture, had already fundamentally defended the project in earlier statements, but questioned an excessive expansion to product categories not previously covered. Voices within the CDU are now growing, calling for the tax to be limited to beverages with a high sugar content.

The fiscal effects of the expansion are being reviewed at the Federal Ministry of Finance under Finance Minister Lars Klingbeil. A spokesperson referred to ongoing interministerial consultations. According to reports, it remains unclear whether the extension will be implemented as an amendment to the existing sugar tax law or through a new legal framework.

International comparisons are regularly invoked in the debate. The United Kingdom, for example, introduced its own sugar tax in 2018, which has also been gradually expanded and extended to new beverage categories. Supporters point to the reform spirit in other European markets, while critics warn of an excessive burden on manufacturers.

The beverage industry is reacting more cautiously than in the initial months of the debate. Individual manufacturers emphasize that diet beverages were frequently developed in response to the original tax and would now once again be affected by a levy. Consumer advocates are calling for clear labeling of the affected products.

Outlook on the legislative process

In the further legislative process, parliamentary deliberations are not expected to begin until after the 2026 summer break. It remains unclear which tax rates are envisaged for the new categories. A possible effective date has also not yet been communicated. Industry representatives expect application no earlier than 2027.

Observers see the expansion as part of a broader strategy to widen the tax base in the consumer sector. Alongside the sugar tax, discussions about higher tobacco and alcohol levies are also on the table. Business associations are calling for a comprehensive review of tax policy so as not to jeopardize competitiveness.

The Ministry of Agriculture emphasizes that the proposals are part of an ongoing coordination process and that changes to the draft remain possible. A final submission to the cabinet is expected no earlier than autumn 2026.
