The Hessian Administrative Court of Appeal (VGH) in Kassel ruled on Thursday that the deviation from the Southern Hesse Regional Plan granted for a Rewe logistics center in Wölfersheim was unlawful, thereby halting – for now – the construction site next to the A45 that has been dormant for six years.
Background of the Proceedings
The lawsuit was brought by the Hessian state chapter of the Bund für Umwelt und Naturschutz (BUND). On Thursday in Kassel, the VGH sided with the environmental organization: the area, which is designated as agricultural land in the 2010 Southern Hesse Regional Plan, may not be used for any other purpose. This derails the plan to build a logistics center for the retail chain Rewe there.
