Mamdani sees no way to arrest Netanyahu in New York after legal review

The background to the matter is Netanyahu's expected trip to the UN General Debate in New York in September. The United Nations General Debate begins each year in late September and draws numerous heads of state and government to the city. The US government would fundamentally have to consent to any action against a foreign head of government on its own soil.

The ICC issued the arrest warrant in November 2024. The Israeli prime minister is charged with war crimes in the Gaza Strip. Israel and the United States have repeatedly questioned the court's jurisdiction and rejected the allegations against Netanyahu.

Mamdani is a member of the Democratic Party. With his statement, he is positioning himself between his original campaign promise and the legal realities in the United States. By shifting responsibility to the federal level and to Trump, he is maintaining his political stance without overstepping the limits of municipal authority.

Legal observers point out that the enforcement of international arrest warrants in the United States is practically impossible without the consent of the federal government. Earlier attempts to enforce ICC measures within the US have also failed due to political and legal hurdles.

The question of whether Netanyahu can attend the UN General Debate despite the outstanding arrest warrant therefore remains open for now. Arrest by local authorities is, according to Mamdani's account, ruled out; federal intervention is considered unlikely. Observers expect Netanyahu to arrive in New York in September as planned.

Mamdani used the occasion to reaffirm his stance against the Netanyahu government without announcing any concrete enforcement measures. He expressly pointed out that the legal review had found that the city had no means to act, but left no doubt about his political position toward the Israeli prime minister.

With the upcoming UN summit in September, the debate over the role of the ICC and the US stance on international arrest warrants is expected to gather further momentum. New York, as the seat of the United Nations, stands at the center of the diplomatic dispute.
