NHTSA grants Zoox exemption for driverless robotaxi without steering wheel

Zoox belongs to the Amazon group and, alongside Waymo, which emerged from the Google ecosystem, and Tesla, is one of the best-known robotaxi developers in the USA. Unlike many competitors, Zoox pursues the approach of a completely symmetrical vehicle without a classic driver's cabin, controlled exclusively by software.

The exemption allows Zoox to deviate from individual FMVSS requirements that, for example, mandate the presence of human controls. The prerequisite is that the vehicle achieves an overall equivalent or higher level of safety—a proof the company must provide to the authority.

Conditions and oversight by the NHTSA

In previous years, Zoox had already conducted test drives with its unusually shaped robotaxi in Las Vegas and San Francisco. In the tests, the company collected data—according to its own statements—on traffic flow, obstacle detection, and interaction with pedestrians to demonstrate readiness for approval.

The NHTSA emphasizes that the approval is tied to conditions. These include, among others, reporting obligations regarding accidents and safety-relevant incidents, as well as regular reviews of the vehicle software. Should serious safety deficiencies arise, the authority can revoke the exemption.

Reactions from the industry

Industry observers see the move as a signal that US regulation is promoting autonomous driving more strongly. The exemption is considered one of the first cases in which a completely stepless vehicle is approved for commercial passenger transport.

At the same time, consumer advocates raise questions about liability in the event of accidents and the cybersecurity of the vehicles. Since no human can intervene, the software must be particularly robust against errors and manipulation, critics argue.

Zoox itself has announced that it will gradually expand its commercial robotaxi service. In a next step, the vehicle is to be tested in additional cities in California and Nevada before broader public operation becomes possible.

Outlook on commercial operations

Waymo has already operated robotaxi services in several US metropolitan areas for several years and is considered the most important competitor. Tesla has also been working on autonomous driving functions for some time, but has so far pursued an approach in which a steering wheel and pedals are still present.

The NHTSA exemption initially applies to a limited number of vehicles and is limited in time. A permanent adaptation of the FMVSS to fully autonomous vehicles continues to be discussed at the national level.

This once again shifts forward the market readiness of fully driverless robotaxis in the USA—with far-reaching consequences for urban local transport, the taxi industry, and the regulatory landscape.

Overall, the decision shows that US traffic authorities are increasingly preparing for a future in which cars are permanently on the road without a human driver. The exemption for Zoox is therefore likely to serve as a precedent for further applications from other manufacturers.
