Overcrowded Prisons: Austria Reports 108 Percent Capacity in Correctional Facilities

Capacity Grows Only on Paper

Ombudsman Gabriela Schwarz, responsible for overseeing penal execution, sees this adjustment as a clear warning sign. She stated verbatim: "The fact that the occupancy capacity has been increased in the past four months can only mean that three or even four people are now being held in rooms intended for two people. If inmates are often locked up in confined spaces for 23 hours, anyone can figure out that this is not conducive." She intensified her criticism with a further statement: "While the number of inmates is increasing – and miraculously, so is the occupancy capacity – the staffing level remains equally low. This is not sustainable in the long run."

Münnichplatz Under Pressure

The situation is particularly critical at the Vienna juvenile detention center JA Münnichplatz. Prison guards reported to APA about additional beds in cells because the capacities for the incarcerated male youths were insufficient. Furthermore, staffing shortages in the executive service are particularly felt during off-peak hours, on weekends, and during admissions after pre-trial detention is ordered. Facility director Seada Killinger countered: "My employees do their utmost every day within their capabilities. Hats off to each and every one of them."

Norbert Dürnberger, chairman of the GÖD prison guard union, spoke of "major problems" at Münnichplatz in an interview with APA: "Fundamentally, there are major problems at Münnichplatz. The service operations would not be possible at one hundred percent without the assistance of the adjacent JA Simmering." He also confirmed that makeshift additional beds are being set up in cells and referred to 120 prison guard trainees, some of whom are completing two-week practical blocks at Münnichplatz.

Josefstadt: Transports Delayed

Shortages are also reported from JA Josefstadt, Austria's largest prison. An entire wing had to be closed due to ongoing construction work, and individual cells are overcrowded. Transports to and from the Regional Court for Criminal Matters tie up personnel who are already scarce due to sick leave. According to APA, this regularly leads to delays in appearances for main hearings.

Relocation of a 15-Year-Old

The fate of a 15-year-old inmate also illustrates the structural bottlenecks. The youth, who was sentenced last year to three years of partially suspended imprisonment for attack planning around Vienna's Westbahnhof and received an additional ten months of unconditional sentence in March 2026 for dangerous threats and false testimony, was transferred from Münnichplatz to JA Klagenfurt in May 2026. At Münnichplatz, he had previously been supervised by a representative of the Extremism Counseling Center, who was working on his deradicalization; he was also connected to the association Neustart. The youth will be released from custody no later than January 2027.

The relocation simultaneously exacerbates a personal hardship: the 15-year-old's mother is wheelchair-bound and will have difficulty visiting her son regularly in Carinthia. The convicted Villach attacker, who is still awaiting classification, is incarcerated in the same facility. This overlap presents additional security and care challenges for those responsible.

On a political level, the Ministry of Justice, together with the Directorate General for Prison and Custodial Services, has implemented relief measures in recent weeks that, according to Dürnberger, are "noticeable." These included transfers, additional support from neighboring facilities, and the targeted deployment of trainees. However, Schwarz sees this as no substitute for a sustainable increase in staffing levels. With regard to the increasing number of mentally ill inmates and individuals under electronic house arrest – a total of 972 people – she demands a permanent increase in personnel and bed capacity.

The next Ombudsman reporting period is expected to provide further insight into whether the recent measures are sufficient to permanently reduce utilization below the 100 percent mark and to bring the burden on employees under control.
