The Higher Administrative Court of North Rhine-Westphalia (OVG) in Münster declared the entire Regional Plan Ruhr (Regionalplan Ruhr) invalid on June 12, 2026, because the Regionalverband Ruhr (RVR) had erroneously determined the demand for sand and gravel.
The 22nd Senate, presided over by Hans-Joachim Hüwelmeier, thus upheld a lawsuit filed by the Kreis Wesel, six affected municipalities, and several residents. At the same time, a raw materials company had filed suit. That company, in turn, wanted to achieve an expansion of gravel mining. The plan had been "recht ordentlich," said Hüwelmeier – nevertheless there had been "gravierende Fehler," the presiding judge explained. These errors ultimately became legally relevant in the complex proceedings.
Specifically, the court objected that the RVR had incorrectly calculated the construction industry's demand for sand and gravel, relying in part on outdated data. Hüwelmeier expressed incomprehension about the methodology: "Dass ein älterer Bericht für eine Zukunftsprognose geeigneter sein soll als ein aktueller, ist erstmal nicht selbsterklärend." The plaintiffs in the Kreis Wesel consider the expansion of gravel extraction exaggerated in any case and argue with the destruction of the landscapes.
