Pension Insurance Adopts Binding Directive for Medical Assessors

The directive defines "Standards für Kommunikation, Transparenz, fachliche Qualität, Fortbildung und Zusammenarbeit", the press release continued. It had been developed in a "breit angelegter Prozess mit allen Verantwortlichen innerhalb der Pensionsversicherung". It was based on "jene hohen Qualitätsansprüche", "die die Begutachtungspraxis der Pensionsversicherung seit vielen Jahren prägen und zuletzt evaluiert und weiterentwickelt wurden".

Obligation to Provide Understandable Information

Assessors must in future explain the purpose of the assessment as well as the procedure of the examination in comprehensible terms. Insured individuals would be given "ausreichend Gelegenheit, ihre persönliche Situation darzustellen". Individual needs and burden situations "werden berücksichtigt". In addition, the PVA referred to the legal entitlement to bring a person of trust from 1 September. Experts are also required to base their assessments "ausschließlich auf Basis objektivierbarer medizinischer Grundlagen".

Experts are furthermore called upon to "niemals" exceed their professional competence "und die Grenzen ihres Fachgebiets", "da dies haftungsrechtliche Konsequenzen haben kann". The directive is available via the link cited in the press release and applies throughout Austria. "Mit der heute beschlossenen Richtlinie unterstreichen wir unseren Anspruch, medizinische Begutachtungen nach dem höchst möglichen Standard durchzuführen. Damit schaffen wir Transparenz und stärken das Vertrauen unserer Versicherten in die Entscheidungen der Pensionsversicherung", said the second chairman Andreas Herz (ÖVP).

Voices from the Self-Governance Bodies

"Medizinische Begutachtungen betreffen Menschen in herausfordernden Lebenssituationen. Mit der neuen Richtlinie schaffen wir dafür nun einen österreichweit einheitlichen und verbindlichen Rahmen." PVA chairman Peter Schleinbach (SPÖ) expressed himself similarly: the self-governance bodies and the staff of the pension insurance stand for "Verantwortung, Verlässlichkeit und Qualität". They wanted to "Vertrauen stärken", Schleinbach said according to the press release.

The background to the decision is a public debate that has been ongoing for months about the quality and conduct of care allowance and pension assessments. Following fierce criticism from interest groups and patient organisations as well as from politicians, the Ministry of Social Affairs and the PVA had already announced a "Maßnahmenpaket" at the beginning of April, which included, among other things, a "Verhaltenskodex" for assessors. The directive now adopted is seen as the binding further development of that package.

Background to the Reform

As early as the previous year, reportedly made statements by PVA chief Winfried Pinggera had caused an uproar. According to Gerhard Ströck, the founder of the We&Me Foundation, Pinggera is said to have spoken of "Trittbrettfahrern" and "Scharlatanen" in reference to ME/CFS patients and their doctors. These remarks further increased the pressure on the pension insurance to make its assessment practice more transparent and to establish binding quality standards.

Renewed criticism was triggered in March by a study commissioned by the Arbeiterkammer Oberösterreich: it spoke of PVA assessments perceived as "wenig" or "gar nicht" respectful, ranging from a "kasernenartigem Ton" to "Anschreien" and accusations of simulation. The study further fuelled the political debate on assessor practices and paved the way for the directive now adopted.

Criticism from the Arbeiterkammer

The PVA emphasised on Monday that it wanted to send a clear signal to insured individuals with the decision. It was aware of the responsibility associated with every single assessment. The new directive was intended not only to safeguard professional quality, but also to bindingly regulate humane treatment of those concerned. In doing so, the institution was responding to long-standing demands from patient organisations and the social partners.

According to the PVA, the directive now presented is part of a comprehensive reform process aimed at modernising assessment practice. Alongside the content of the directive, its implementation is also a central concern. Continuing education, evaluation, and regular review of assessors are to ensure that the standards are actually observed. Violations of the directive may in future have consequences under disciplinary and liability law.

Implementation and Next Steps

Patient organisations reacted with cautious optimism to the decision. While the basic direction was welcomed, critics pointed out that binding rules alone did not yet guarantee an improvement in practice. What mattered would be how the directive was actually lived by and monitored in the coming months. The next steps are to consist of ongoing observation by the PVA's self-governance bodies and a regular report to the Ministry of Social Affairs.

In politics as well, the decision was regarded as a long-overdue step. Representatives of several parliamentary groups had repeatedly called for reforms at the pension insurance in recent weeks. The new directive is therefore seen as the first concrete result of the package of measures announced in April. Whether it can restore the PVA's lost reputation among the public will only become clear in the coming months.

The pension insurance pledged to closely monitor the implementation of the directive. Training for the appointed experts had already begun, the institution said. A central point of contact for complaints from insured individuals is also to be expanded. The aim was to ensure that the new standards do not merely exist on paper, but actually take effect in the day-to-day reality of assessments.
