Prosecutor in charge of the Pilnacek case heard by the inquiry committee

During her hearing, the prosecutor outlined the grounds for this decision. She indicated that the dropping of the proceedings was based on the absence of any determining change in the evidentiary situation. « Begründet wurde die Einstellung damit, dass es keine maßgebliche Änderung der Beweislage gegeben habe », she explained before the members of parliament.

Hierarchical review of the decision

The decision to close the case was subject to a double hierarchical review. The public prosecutor's office specified that the approach had been « durch die Oberstaatsanwaltschaft (OStA) Wien und das Justizministerium geprüft und genehmigt », that is, examined and approved both by the Vienna General Prosecutor's Office and by the Federal Ministry of Justice.

As a reminder, the proceedings had been withdrawn from the Krems an der Donau public prosecutor's office and transferred to that of Eisenstadt by the Vienna General Prosecutor's Office. This removal was intended, according to the official formulation, to « jeglichen Anschein einer Befangenheit zu verhindern », in other words to prevent any suspicion of bias in the handling of this sensitive case.

The transfer of the case to Eisenstadt

The transfer responded to a concern for apparent impartiality, in a context where the initially seized public prosecutor's office was perceived as potentially exposed to conflicts of interest. The choice of Eisenstadt, a jurisdiction outside the Vienna area, was meant to guarantee an investigation perceived as independent by public opinion and by the political formations involved in the inquiry committee.

The committee's members of parliament, among whom are representatives of the ÖVP and the FPÖ, as well as members of other formations, were able to question the magistrate on the investigative elements carried out so far, on the expert assessments conducted, and on the reasons why no new element justified continuing the proceedings. The exchanges, transcribed as part of the parliamentary work, fall within the committee's mission of executive oversight.

The death of Christian Pilnacek, a former figure of the Austrian public prosecution service, had triggered a wave of political and media questioning. Several parliamentarians, including Christian Hafenecker and Andreas Hanger, had called for the creation of an inquiry committee to shed light on the circumstances of this death and on any potential political responsibility.

The political context of the inquiry committee

Beyond the questions raised by the fate of the judicial proceedings, the inquiry committee is looking into the conditions under which the authorities handled the information relating to this case, as well as the interactions between the Ministry of Justice and the senior civil service at the time of the events. The hearing of the prosecutor is part of this parliamentary review process.

With the Ministry of Justice and the Vienna General Prosecutor's Office having validated the decision to drop the case, any subsequent resumption of the proceedings appears unlikely in the current state of affairs. However, the parliamentary committee may continue to hear witnesses and examine documents in order to determine whether political responsibilities, distinct from criminal liability, may be identified in this case.

The hearing of the prosecutor nevertheless constitutes a key step in the committee's work. It allows members of parliament to exercise their oversight over the manner in which the justice system handled this sensitive case, and to verify whether the guarantees of impartiality announced during the transfer of jurisdiction to Eisenstadt were actually respected throughout the proceedings.

Several political formations have already indicated that they could demand the convening of other witnesses, notably former officials of the Ministry of Justice, in order to clarify the remaining grey areas around the circumstances of Christian Pilnacek's death and the functioning of the judicial apparatus in this case.
