Raiffeisen Bank International (RBI) announced on Thursday that it intends to file a damages claim of approximately €3.15 billion against the holding company Rasperia Trading Limited in Austria as soon as the latter's assets frozen in Austria are released.
As RBI stated in an ad-hoc announcement, the lawsuit is to be filed in full compliance with EU sanctions law. The aim is to gain access to Rasperia's assets frozen in Austria due to EU sanctions. According to RBI, the assets in question are 28.5 million shares in the construction group Strabag, as well as withheld dividends and cash distributions.
RBI justified the step with a ruling by the court of first instance for commercial matters in the Russian city of Kaliningrad, which was handed down on Wednesday and published in the register on Thursday afternoon. The judge, Marina Nadeshkina, largely prohibited the core shareholders of the Austrian company Strabag and their associates from taking action against Rasperia abroad. The proceedings had been conducted in non-public form at the request of the plaintiff, Rasperia.
