The planned amendment to the Assisted Dying Act, in force since January 2022, has drawn sharp criticism during the expert review process from church representatives, patient advocates, and legal experts.
The planned amendment to the Assisted Dying Act, in force since January 2022, became necessary because of a ruling by the Constitutional Court (VfGH) from late 2024. At the end of 2024, the VfGH had struck down the provision requiring that an assisted dying declaration be renewed after one year — and that the entire elaborate procedure for the initial application must be gone through again each time. The VfGH set a deadline of 1 June 2026 for a repair; this deadline has already passed.
