Syrian Refugees: Less Asylum in Austria After Assad's Fall

What subsidiary protection means

The asylum statistics distinguish between three forms of protection: full asylum entitlement, subsidiary protection, and humanitarian residence permits. Subsidiary protection applies above all when there is no individualized ground for persecution, but there is nevertheless a serious threat to life and limb in the country of origin. This form of protection is temporary and can be revoked if the situation improves.

For many Syrian refugees, the change in protection status has noticeable consequences. With subsidiary protection, family reunification is more restricted, among other things, and residence permits are issued more frequently only for shorter periods. Lawyers in asylum law report that those affected have had to adjust their long-term life planning in Austria accordingly.

The figures from the Interior Ministry also show that the total number of asylum applications from Syria has continued to decline in recent months. At the same time, the share of subsidiary protection decisions among all decisions on Syrian applicants rose significantly. Observers interpret this as a direct consequence of the reassessment of the situation in Damascus and in the former Assad-held areas.

Consequences for other countries of origin

In addition to Syrians, similar shifts are also affecting other large groups of origin. For Afghan and Iranian nationals, it was also reviewed to what extent the granting of protection still corresponds to the current security and human rights profile. There too, the share of subsidiary protection decisions compared to full asylum status is higher than in earlier comparison periods.

In legal terms, Austria is thereby also following the requirements of the European Union. The EU directives provide for subsidiary protection to be regularly adjusted to the situation in the country of origin. According to the ministry's assessment, a lasting improvement in the security situation in Damascus could lead to future decisions being made even more frequently with temporary titles rather than full asylum.

Advisory centers record more inquiries

For those affected, the change means they have to renew their residence status more often and have less planning certainty. Advisory centers in Vienna, Graz, and Linz are recording increased inquiries about the consequences of the new classification. Caritas and other relief organizations advise those affected to seek legal advice early and to keep documents ready for the upcoming renewal procedures.

The Interior Ministry emphasizes that no ongoing asylum procedures will be reassessed retroactively. Recognized asylum beneficiaries will retain their status. Changes affect only new applications and upcoming renewals. This is intended to prevent already integrated Syrians from losing their protection status at short notice.

Debate over voluntary return

Meanwhile, the discussion about the return of Syrian refugees continues. Interior Ministry spokesperson Lukas Gahleitner-Gertz had repeatedly pointed out that a subsidiary protection status does not preclude the possibility of voluntary return. Advocates of an active return policy see this as an additional argument for providing greater support to organizations facilitating voluntary returns home.

Overall, it is becoming apparent that Austrian asylum policy for Syrian refugees is being shifted toward a more case-by-case examination. While humanitarian arguments continue to play a role, automatic protection through blanket assumptions about the situation in Syria is becoming less common. How this will affect the long-term integration of the people concerned will only become clear in upcoming evaluations.
