A trial against the doctor Josef Gallauner began on Thursday at the Krem Regional Court. The public prosecutor's office accuses him of having caused the death of a newborn baby by failing to perform a timely caesarean section.
According to the indictment, the accused, as the treating physician, allegedly failed to carry out the medically indicated ultrasound examination. Despite a pathological CTG, lack of progress in labour, reduced amniotic fluid, and the delivery date being exceeded by seven days, he did not recognise the situation as medically urgent.
The charge further alleges that Gallauner did not perform a caesarean section at around 10.30 a.m., although the indication for it had already existed. The procedure was only carried out shortly after 2:00 p.m. – several hours later than, in the prosecution's view, necessary.
