A civil trial began on Wednesday before the Regional Court of St. Pölten in which the Republic of Austria and the state of Lower Austria seek to clarify the billing of guest patients at the University Hospital Tulln.

The dispute centers on the question of which hospital laws apply to the University Hospital Tulln, opened in 2024. The hospital emerged from a cooperation between the Lower Austria State Hospitals Holding and the Medical University of Vienna and uses buildings of the Klinik Hieting in Vienna. The opposing side argues that this means the Vienna Hospital Act, and not that of Lower Austria, must apply.

Judge Peter Martschini said in an earlier procedural filing: „Es besteht aber keine Verpflichtung der beklagten Partei, von sich aus ein bestehendes Gesetz wie das Wiener Krankenanstaltengesetz auf eine etwaine Verfassungswidrigkeit abzuklopfen und zur Seite zu schieben.“
