Judge Noel Wise, on behalf of a US federal court in California, has ruled that the Trump administration violated the US Constitution by revoking the visas of pro-Palestinian activist students.

Background of the Proceedings

The ruling is directed against the US State Department and the Department of Homeland Security, which had revoked the visas of several foreign students in recent months. Those affected included activists at Stanford University, as reported by the student newspaper The Stanford Daily. The court has now declared these measures unconstitutional.

In her written opinion, Judge Noel Wise stated that the government had violated the free speech rights of those affected. She pointed out that political statements and protest actions, even when expressing sharply criticized positions, fall under the protection of the First Amendment. A purely politically motivated termination of stay is not legally permissible.
