The conviction handed down at the Innsbruck Regional Court against Signa founder René Benko to 30 months of unconditional imprisonment for fraudulent bankruptcy has been final since Tuesday, after the Oberster Gerichtshof (OGH) raised no objections.
The decision marks the provisional end point of one of the most sensational economic criminal proceedings in Austria in recent years. Benko was found guilty on Tuesday at the Innsbruck Regional Court because, in the course of the collapse of his real estate empire, he is alleged to have moved assets aside. The court, presided over by Judge Hofer, imposed an unconditional prison sentence of 30 months.
With the date the verdict has now become final, it is established that the sentence can be enforced without any further suspensive effect, provided no extraordinary remedies still apply. The public prosecutor's office had originally argued for a more severe sentence; the defense, on the other hand, had pushed for an acquittal or at least a conditional sentence.
