Vienna Torture Trial: Closing Arguments and Verdict Expected After 13 Hearing Days

According to the public prosecutor's office, the torture served to "die damalige Protestbewegung gegen das Regime zu unterdrücken und die Bevölkerung einzuschüchtern." The severe physical abuse was used to force those detained into confessions.

In the course of the proceedings, several affected individuals who had traveled specially from abroad gave powerful testimony about the violence they experienced. The evidentiary proceedings have formally been concluded in this case; the closing arguments by the prosecution, victim representation, and defense, as well as the announcement of the verdict, are now scheduled for Monday afternoon.

Status of the Proceedings

Khaled Al H. has been in pretrial detention at the Vienna-Josefstadt detention facility since the end of 2024. The two defendants rejected the charges brought against them in court and attempted to downplay their respective roles in the Syrian state apparatus.

Should the defendants be convicted in accordance with the indictment, they face up to ten years in prison. According to the court, it is still not foreseeable how long the deliberations of the lay-judge panel on questions of guilt and sentencing will take.

Significance Beyond the Individual Case

The trial is considered one of the first attempts to hold representatives of the regime of Bashar al-Assad — overthrown in 2024 — accountable before a European court for systematic torture in Syrian detention facilities. International observers are following the Vienna proceedings with great interest.

The Federal Government Commissioner for Human Rights had described the opening of the proceedings as an important signal for the reckoning with the most serious human rights violations. For numerous affected individuals from Syria, some of whom had traveled to Vienna specifically for the purpose, the public evidentiary hearing was also personally significant.

With the verdict on Monday, the first major Vienna trial chapter will close. Possible further proceedings against alleged responsible persons from the Syrian security apparatus are considered likely by observers, but have not yet been scheduled publicly.
