14-Year-Old Girl Charged with Murder in Vienna Cemetery Killing

If the 14-year-old is deemed incompetent in a new assessment, she would be placed in a forensic-therapeutic center under § 21 Abs 1 StGB and could be released earlier than under § 21 Abs 2 StGB. The penalty for murder for juveniles aged 14 to 16 is up to ten years imprisonment.

The Austrian victim was discovered by a passerby at 17:30 on the cemetery in Vienna-Penzing with numerous stab and cut wounds and could not be resuscitated. The mentally ill juvenile was later arrested by the police in the socio-psychiatric shared apartment where she had lived since November as a prime suspect in the case.

Details of the Crime

During the arrest, a pocket knife as the alleged murder weapon, blood-stained clothing, and her mobile phone were seized. During her interrogation, the juvenile confessed to the investigators of the State Criminal Police Office but did not provide any further information about a motive.

According to MA 11, the Viennese juvenile had never been known to the police for criminal offenses before and likely chose the victim at random. The juvenile allegedly took ten tablets of a prescription sedative from the group of benzodiazepines before the crime.

The defendant's lawyer, Astrid Wagner, stated that the requested assessment does not appear conclusive and hopes for a request for placement in a forensic-therapeutic center under § 21 Abs 1 StGB due to incompetence. The indictment is not yet legally binding.

Legal Proceedings

If placement in a forensic-therapeutic center is ordered in addition to the prison sentence, the affected person can be detained indefinitely even after serving the sentence. According to reports, a video of the act allegedly exists on the mobile phone.
