A 14-year-old girl is facing a murder charge for allegedly stabbing a 67-year-old woman to death on February 23 at the Baumgarten cemetery in Vienna.
The prosecution has filed a murder charge against the defendant, who has been deemed capable of being held accountable by an expert. However, an objection has been raised against the indictment, and a request for an additional psychiatric assessment has been made.
The case is currently under review by the Vienna Higher Regional Court (OLG), with the case file having been with the court since May 6. The objection to the indictment criticizes the requested placement in a forensic-therapeutic center according to § 21 Abs 2 StGB.
An expert commissioned by the prosecution diagnosed the 14-year-old with an unstable personality disorder while acknowledging her sense of injustice and deemed her culpable. The defendant is currently provisionally housed in the forensic-therapeutic center of the Asten correctional facility.
