Australia Doubles Penalties for Tech Giants Over Weak Implementation of Social Media Ban for Minors

Prime Minister Anthony Albanese justified the tightening in clear terms: „Es ist klar, dass die großen Tech-Konzerne nicht genug tun, um das Gesetz einzuhalten – es sind immer noch zu viele Kinder in den sozialen Medien.“ The government therefore sees itself compelled to tighten the legal framework and increase the pressure on the platforms.

In addition to the harsher penalties, the regulatory authority eSafety Commissioner is also to receive additional powers to demand information from the companies. This is intended to make supervision of compliance with the ban more efficient, particularly affecting providers such as Meta with its service Instagram.

According to the government, the Australian regulatory authority is currently investigating five platforms for possible violations of the new rules. The names of all the services under investigation have not yet been fully made public; it is known that Instagram is among them. Should the investigations confirm violations, the new maximum penalties could be applied immediately.

Criticism of Implementation by the Platforms

Communications Minister Wells sharply criticized the industry, saying the platforms were using „die üblichen Tricks der großen Tech-Konzerne an und tun nur das Nötigste, um den Vorschriften Genüge zu tun“. This attitude has prompted the government to significantly expand both the sanctions and the supervisory powers.

The social media ban for under-16s came into force in December 2025 and is one of the most far-reaching regulations of its kind worldwide. Initial evaluations had shown, however, that many young people were able to circumvent the age checks with simple means and that numerous platforms were only sluggishly adapting their technical precautions.

International Significance of the Model

With the now planned doubling of the penalty framework, Canberra is responding to the previously limited deterrent effect of the law. Industry associations of the tech companies have announced that they will carefully examine the proposals and point to investments in age verification systems. The government, however, makes clear that it wants to stick to swift parliamentary proceedings.

Observers see the move as a test case for similar regulatory approaches in other Western democracies. Should the Australian model prove to be enforceable, it could, according to experts, serve as a template for legislative initiatives in Europe and North America. Human rights and child protection organizations welcomed the tightening, but at the same time called for independent studies on the actual effectiveness of the age limit.

It remains unclear when the new maximum penalties will formally come into force. The government announced that it would introduce the corresponding draft bill into parliament shortly. Until then, the existing maximum limit of 49.5 million Australian dollars applies, which is already regarded internationally as one of the highest sanctions in the field of online regulation.
