Australia establishes central AI office and plans national rules for data centers

In his speech, Albanese described artificial intelligence as key to the country's productivity, economic resilience, and technological sovereignty. Australia wants to take a leading role in regulating AI.

According to the plans, Parliament is to pass a corresponding law on data center standards at the beginning of next year. Albanese wants to secure the agreement of the states and territories to the planned standards at a meeting of the National Cabinet the following month.

Strict requirements for large data centers

Specific requirements are planned for large AI data centers: operators are to reduce the water consumption of their facilities as much as possible and feed at least as much energy back into the electricity grid as their facilities consume. The costs of connecting to the electricity grid are to be borne by the operators themselves.

In the area of copyright, Albanese announced that Australian law will unambiguously establish that creators retain control over their works. "Our laws will unambiguously establish this," the Prime Minister said.

Specifically, he demanded that Australian writers, musicians, artists, and journalists must remain owners of their works and retain control over them. No company should use Australian books, music, art, or news to develop or train AI systems, "without the artists having control over it — including control over the price and value of their works."

Albanese described use without such control as theft: "Everything else is theft." Australia thereby wants to be the first country in the world to enshrine a national regulatory framework for AI in law.

The planned measures link economic, environmental, and cultural objectives. While the data center standards primarily target the energy and water consumption of the often power-hungry facilities, copyright protection is intended to shield creatives from the unpaid use of their content for training AI models.

Open questions on implementation and timeline

With the establishment of the Office of AI, the Australian government is gaining a dedicated instrument to politically accompany the rapidly growing technology. Its placement within the Prime Minister's department underscores the importance the government attaches to the issue.

It initially remained unclear exactly how the standards will be technically monitored and enforced. The precise timetable for Parliament's consideration of the data center law is also still pending, although the government has already announced the draft for early next year.

Overall, with the announced steps, Australia is pursuing a comprehensive approach that links regulation, location policy, and the creative economy. If the plans are implemented, Australia would, according to its own description, be the first country with a nationally binding AI regulatory framework.
