Austria's health insurer ÖGK welcomes expanded nicotine rules covering pouches, toothpicks and snuff powder

ÖGK said the change was important because such products, which do not contain tobacco leaf but deliver nicotine, had grown in popularity and could otherwise be marketed without the restrictions that apply to cigarettes and similar goods. The fund argued that aligning the rules would make consumer information clearer and reduce the appeal of nicotine products to young people.

Background to the regulatory change

The new provisions were reported on 21 August 2026 by the Austrian Press Agency (APA) and covered by several domestic outlets. Austrian officials had previously signalled that the revision of the TNRSG was designed to keep pace with a fast-evolving nicotine market, where novel formats such as pouches and toothpicks had emerged alongside established snuff products.

ÖGK also pointed to enforcement measures in the revised law. The fund said authorities would have expanded powers to inspect retailers and online sellers, and that repeat offenders — referred to in German-language coverage as "Wiederholungsfällen" — would face higher penalties under the updated penalty schedule.

Speaking for ÖGK, a spokesperson underlined that the goal of the regulation was not to criminalise users but to ensure that tobacco-free nicotine items were sold and advertised under the same safeguards as other nicotine products. The insurer framed the move as a preventive health measure consistent with Austria's broader tobacco-control strategy.

Enforcement and penalties

Public health advocates have long argued that nicotine pouches, in particular, are sometimes marketed in flavours and packaging that appeal to teenagers. ÖGK said the new rules would restrict flavour descriptions and require clearer health warnings on packaging, bringing the products into line with European Union norms on tobacco and nicotine labelling.

Retailers across Austria were given a transition period to adjust labelling, signage and online listings. ÖGK noted that smaller shops and tobacconists had been offered guidance materials and an information hotline to help them comply before inspections begin in earnest.

What changes for retailers and consumers

The fund added that it would work with schools, sports clubs and youth organisations to communicate the changes to adolescents and their families. Information leaflets and online materials explaining the new limits on advertising and product placement are to be distributed through the insurer's regional branches.

Austria is among several European countries that have moved in recent years to regulate tobacco-free nicotine products more strictly. ÖGK said it would monitor the impact of the rules on consumption patterns and report back to the federal ministry responsible for health within twelve months of entry into force.
