On Tuesday, the National Council passed a ban on disposable e-cigarettes as well as a prohibition on the distribution of tobacco-free nicotine products such as pouches to under-18s, accompanied by new penalty provisions for violations of tobacco and nicotine law.
With the adopted amendments, the distribution of disposable e-cigarettes and tobacco-free nicotine products such as pouches to under-18s is prohibited. The aim is to further restrict young people's access to nicotine-containing products. In addition, maximum nicotine limits and warning notices for such products, as already apply to classic tobacco products, are to become possible in the future.
State Secretary Ulrike Königsberger-Ludwig described the reform as an important step in youth protection. Damit schließe man eine wirkliche Lücke im Jugendschutz, she said with a view to the growing spread of pouches and disposable vapor devices. At the same time as banning distribution to young people, the reform also creates the possibility of maximum nicotine limits and warning notices for such products.
Penalties for violations
Administrative penalties are provided for violations of the new provisions. From the 20th onward, those who fail to comply face fines of 500 euros; in repeated cases, up to 2,000 euros may be imposed. The sanctions are directed, among others, at retailers who fail to comply with distribution rules.
