Authorities close pig breeding farm in Lower Austria following animal cruelty allegations

According to the office of the provincial councillor responsible for animal welfare, Susanne Rosenkranz (FPÖ), the farm had previously been inspected on a regular basis: "The responsible authorities acted immediately once the case came to light and drew the necessary consequences," it was reported, according to ORF. There had been no complaints up until December. Only after the mistreatment became known were immediate measures initiated and the farm shut down.

The authorities also ordered that the surviving animals be given veterinary care and housed in conditions appropriate to animal welfare standards. The farm owner, who does not belong to the persons accused by name, now faces an ongoing criminal proceeding. Should the suspicion be confirmed, he faces a permanent livestock-keeping ban as well as a substantial fine under the Animal Welfare Act.

Reactions from politics

In the Mostviertel region and the neighboring district of St. Pölten, the case has triggered a broad debate over the effectiveness of inspections carried out to date. Animal welfare organizations such as VGT have for years been calling for stricter unannounced inspections and harsher sanctions for repeat violations. Animal rights advocates cite the incidents in Lower Austria as evidence of the need to reform enforcement.

Provincial Councillor Rosenkranz announced her intention to push for a legislative amendment at the federal level. According to ORF and the "Kronen Zeitung," a livestock-keeping ban should in future be issued immediately in cases of dramatic incidents, without the need to wait for court proceedings. Until now, such a prohibition has only been possible after a legally binding verdict — something critics describe as an enforcement deficit.

Consequences for the operation and the livestock owner

The case evokes memories of earlier scandals from so-called "Horror Farm" reporting, in which conditions at some livestock operations were sometimes described as "the greatest possible suffering." Animal welfare associations are insisting that the public prosecutor's office investigate swiftly while also reviewing the living conditions of remaining animals at other operations in the region.

The office of the provincial councillor further stated that it was in close contact with the public prosecutor's office in St. Pölten as well as with the responsible district administrative authorities. Once the investigations have been completed, a final report is to be presented, which will also indicate what organizational consequences are being drawn within the veterinary authorities.

Alongside the criminal proceedings, the case is also occupying the agricultural interest representation. Representatives of the Lower Austrian Chamber of Agriculture emphasized that the irresponsible actions of individual farms must not be attributed to the industry as a whole. At the same time, they demanded that tips from the public be followed up on more quickly in the future in order to put an early stop to such conditions.

Investigations and open questions

The public prosecutor's office confirmed that investigations have been opened on suspicion of animal cruelty and a possible breach of duty of care. No specific suspect was initially named publicly. Investigators are currently evaluating evidence, including records of veterinary care as well as the results of pathological examinations of the dead animals.

In parallel, the responsible district administration is examining whether the farm owner can already be provisionally banned from keeping livestock. Such an order would be possible before a legally binding verdict but would have to be applied for by the public prosecutor's office and approved under administrative law. Observers expect a decision in the coming weeks.

Animal welfare organizations have meanwhile called for donations to finance the care of the rescued animals. Some of the pigs have been placed in animal shelters and foster homes, according to the VGT. In the long term, the associations are calling for a nationwide livestock-keeping database in which violations of the Animal Welfare Act are recorded centrally.
