The Federal Court of Justice has overturned the manslaughter verdict against a heart specialist at Charité and referred the case back to the Berlin Regional Court. In the new trial, a different criminal chamber will have to reassess possible murder characteristics.

The Federal Court of Justice (BGH) in Leipzig has overturned the verdict of the Berlin Regional Court against a 56-year-old heart specialist at Charité and ordered a retrial in which possible murder characteristics are to be reassessed.

Background: Conviction for manslaughter

The 5th Criminal Senate of the Federal Court of Justice (BGH), based in Leipzig, overturned the verdict of the Berlin Regional Court. As a result, the physician – who in April 2024 had been sentenced to four years in prison for manslaughter in two cases – must now answer for the charges in a new proceeding. The case will be heard by a different criminal chamber at the Berlin Regional Court.
