The Constitutional Court (VfGH) has rejected as inadmissible urgent applications from parents against the planned headscarf ban for female pupils under 14 at Austria's compulsory schools, which is set to come into effect in early September.

Reasoning of the court

As the VfGH announced on Thursday, the individual applications were directed against the headscarf ban in schools for girls under 14. However, the ban only enters into force in early September, which is why, in the court's view, the applications were premature.

In its reasoning, the Constitutional Court held that the minor applicants could continue to wear a headscarf at school without hindrance, as before. Nor would the applicants, as those entitled to exercise parental authority, yet have to fulfil any of the obligations set out in the provisions being challenged.
