Federal Government Plans Extensive Powers for Domestic Intelligence and BND

According to the federal government, the draft comprises more than 700 pages and primarily affects three laws: the Federal Office for the Protection of the Constitution Act (Bundesverfassungsschutzgesetz), the BND Act, and the regulations governing oversight by the Independent Control Panel of the Bundestag. The reform thus cuts deeply into the previous architecture of Germany's intelligence services, which traditionally distinguishes between observational reconnaissance and active threat prevention.

Three Laws at the Core

In delimiting these powers, the draft sets clear legal boundaries: targeted injury or killing are to remain expressly impermissible. The aim of the new regulation is to make the security agencies operational in an increasingly hybrid threat environment without crossing into the realm of military or police coercive measures. According to the government's wishes, the powers are to remain expressly tied to strict constitutional and supervisory requirements.

In the political debate, the project has met with criticism that is in part fundamental. The Greens and the FDP point to the already broad catalogue of powers held by the services and warn of an erosion of civil rights standards. Supporters from the CDU and CSU, by contrast, argue that cyberattacks, disinformation campaigns, and sabotage operations originating abroad have long been a reality, and that the authorities can barely counter them with the means currently at their disposal.

Political Debate and Oversight

A particular role in the discussion is played by the Independent Control Panel of the Bundestag, which in future is also to have a say over the new operational interventions. Its chair, Konstantin von Notz, had repeatedly called in earlier statements for a strengthening of parliamentary oversight without politicising every single operation. The draft provides that the Panel must be informed in advance and in real time when the services resort to active measures.

At the same time, the reform raises constitutional questions. The Federal Constitutional Court (Bundesverfassungsgericht) has emphasised in several rulings that the use of intelligence methods is always bound by the principle of proportionality. Critics fear that the new instruments could create a grey area in which the services effectively perform police-like functions without being subject to the stricter rules of criminal prosecution.

Observers also assess the reform against the backdrop of the geopolitical situation. The federal government describes Germany as one of the largest economies on earth and therefore as a priority target of foreign espionage and sabotage operations. In the government's view, this makes it necessary to noticeably increase the services' ability to respond.

Geopolitical Background

Alexander Dobrindt, regarded as the central political driver of the reform, has stressed in previous statements that the matter is not about expanding intelligence powers for their own sake, but about closing concrete capability gaps vis-à-vis cyberattacks and hybrid warfare.

In the parliamentary process, a lengthy discussion is shaping up. The responsible Bundestag committees will deliberate on the draft in several expert hearings over the coming months. In addition to interior and legal policy makers, experts in constitutional law, cyber security, and supervisory law are expected to be heard.

It remains unclear to what extent the reform can actually be passed before the Bundestag election. Should it not be adopted in time, according to assessments from the ministries involved, only a transitional mechanism extending the existing competences would remain.
