Federal Government Pushes Ahead with Expansion and Price Oversight for District Heating

Key elements of the draft include a nationwide uniform price oversight regime, new requirements for contract design between utilities and customers, and simplified approval procedures for pipeline construction. In the future, municipalities are to have a greater say in the expansion of heating networks, for example through mandatory heat planning and connection rules for new development areas.

Voices from Industry

At the housing industry association GdW, the initiative met largely with approval. President Ingbert Liebing welcomed the federal government's intention to facilitate expansion but simultaneously demanded that profitability for landlords be preserved. Otherwise, he warned, rising ancillary costs would threaten to place additional burdens on millions of tenant households.

The Association of Municipal Utilities (VKU) also responded with cautious positivity. Chief Executive Ingbert Liebing — who heads the VKU — stressed that stronger official oversight could strengthen confidence in district heating, provided it is paired with clear rules rather than interference in established supply structures. The municipal energy industry already supplies around two-thirds of Germany's district heating today.

Felix John, Managing Director of the German Heating Industry Association (Bundesverband der deutschen Heizungsindustrie), described the step as significant. „Deshalb ist es ein wichtiger Schritt, dass die Bundesregierung mehr Transparenz schaffen und eine behördliche Preisaufsicht einführen will. Das sind zentrale Voraussetzungen, um Vertrauen in die Fernwärme zu stärken“, sagte John. At the same time, he warned against weakening the competitiveness of medium-sized providers through excessive regulation.

Price Oversight and Consumer Protection

District heating providers and municipal utilities see in the draft an opportunity for uniform competitive conditions. Until now, municipal utilities in various federal states have had to deal with different approval requirements, pricing rules, and connection mandates. A nationwide harmonization could significantly simplify the planning of major pipeline projects, according to industry representatives.

Critics, including consumer protection associations, had in the past mainly objected to non-transparent price escalation clauses and one-sided contract designs by individual providers. The draft now presented provides that price changes must in future be disclosed and reviewed by the supervisory authority. Violations are to be punishable by fines.

Further Proceedings

In the parliamentary process, the Bundestag and Bundesrat will now deliberate on the reform. Observers expect adjustments, since the federal states in particular have co-determination rights in heat planning. Business associations announced that they would push forcefully for practical transitional arrangements.

With the amendment, the federal government is pursuing the goal of significantly increasing the share of district heating in Germany's heat supply. Currently, an estimated 14 percent of households are supplied with district heating; according to federal government plans, this share is to rise significantly by 2045 in order to achieve climate targets in the building sector.
