FPÖ demands extradition of former police chief, ÖVP opposes

The Vienna Regional Court has meanwhile confirmed that it is reviewing possible steps in the case. The Vice President of the court, Christina Salzborn, said in response to an APA inquiry regarding media reports about an arrest and a possible extradition request: "Man wird das entsprechend prüfen kommende Woche." So far, there are no official reports from Syria received through official channels, according to Salzborn.

Unclear Circumstances of the Arrest

It remains unclear how Moussab Abou R. was able to reach Syria. According to a photo circulating on the internet, he was welcomed by his family upon his arrival in the province of Daraa. In the image, he can be seen smiling with a Syrian flag. However, the photo is not officially confirmed and originates from social media.

Legally, an extradition in such cases would generally require an application from the Syrian authorities, which would proceed through the Justice Chancellery and the Federal Ministry of Justice. Only after a positive review could the Higher Regional Court (OLG) make a decision. As long as no formal application is submitted, the status quo remains open.

Legal Framework of an Extradition

The case has led to an open dispute between the two governing parties, the FPÖ and the ÖVP. While the FPÖ is pushing for a swift resolution and extradition, the ÖVP insists on due diligence under the rule of law and consideration of international standards. Both sides invoke the applicable Mutual Legal Assistance Act and international agreements.

Observers point out that the political dimension overshadows the legal one. The FPÖ has raised the issue in the National Council and sees the case as a test for the consistent application of existing extradition agreements. The ÖVP, in turn, emphasizes that extradition to a country with documented practices of torture would be legally and morally problematic.

Human Rights Concerns

The human rights organization CEHRI has also intervened in the debate. It calls for a comprehensive clarification of the case and warns against extradition should it violate European and international standards. CEHRI cites reports of torture and enforced disappearances in Syrian detention facilities.

The role of the Syrian family member Firas Yehia, who is also mentioned in media reports, also remains unclear. There have been no official statements regarding his precise connection to the arrest and reception in Daraa. The Austrian authorities have also not commented on this so far.

The Vienna Regional Court has announced that it will provide an initial assessment next week once all relevant information is available. Until then, the case remains suspended between political demands, legal review, and humanitarian concerns.
