FPÖ sues over ORF chief appointment due to lack of professional experience

FPÖ's arguments

The complaint is directed against the responsible regulatory authority KommAustria, which conducted the selection procedure and confirmed the designated ORF chief. The FPÖ argues that KommAustria did not sufficiently examine the minimum requirements set out in the job posting text.

According to the FPÖ's account, the lawsuit also has a political dimension. Hafenecker used the press conference to sharply criticize the ORF reform plans of the coming weeks. Verbatim, he announced that the reform summit scheduled for September would deliver "genau nichts." The FPÖ sees this as an attempt to distract from the structural flaws in the appointment.

Political reactions

With the complaint to the Administrative Court, the FPÖ wants to achieve a suspension or re-tendering of the ORF chief appointment. Until a court decision is made, the designated person formally remains in office, but may be impaired in exercising the function. Proceedings before the Administrative Court typically last several months.

The SPÖ criticized the lawsuit as a politically motivated action. From the ranks of the Social Democrats, it was said that the FPÖ merely wanted to use the legal step to whip up sentiment against the public broadcaster. KommAustria itself has so far not publicly commented on the lawsuit. A statement from the authority was announced for the coming days.

The invocation of the missing proof of experience is legally delicate. The FPÖ must prove that the designated person actually does not have the required five years of professional experience in TV and radio. If KommAustria examined internal documents during the selection procedure, the court could dismiss the lawsuit as unfounded.

Possible consequences

The FPÖ lawsuit is supported by prominent constitutional experts, who regard the process as a fundamental question of adherence to tender requirements. The complaint could be groundbreaking for future appointments to public functions where qualification requirements are defined in the tender.

The designated ORF chief, Clemens Pig, has not so far commented directly on the allegations. From the ORF, it was only said that it would not publicly comment on ongoing proceedings and would await judicial clarification. The APA agency, which is reporting on the proceedings, also refrained from commenting.

In domestic policy terms, the FPÖ sees the lawsuit as a signal to the black-green federal government. The party is demanding a complete relaunch of the appointment process and a transparent review of all application documents. Should the Administrative Court uphold the complaint, this would be the first case in which an ORF chief appointment is overturned on formal grounds.

Christoph Urtz, who appeared as spokesperson for FPÖ media policy, spoke of a "Systemversagen" in filling the key position at the ORF. The Freedom Party announced that it would table a parliamentary inquiry in the National Council regarding KommAustria's appointment practices, in order to clarify political responsibility.
