Possible Electronic Bracelet and Immunity

Should Le Pen be elected president before the sentence is enforced, she would enjoy presidential immunity under French law. In that case, the sentence could only be carried out after the end of her term in office.

In polls, Le Pen has been leading for months with over 30 percent. Her chances of reaching the runoff are considered fairly good. Marine Le Pen is the candidate of the party Rassemblement National (RN, formerly Front National) for the 2027 presidential election.

At first instance, Le Pen's passive voting rights had been revoked for five years with immediate effect. The appellate court reduced this disqualification to 15 months, which she has already served. The current ruling therefore differs from the first-instance ruling in one key respect.

Difference from First Instance

In substance, the case concerns the embezzlement of EU funds. The appellate proceedings confirmed the sentence against Le Pen and other RN officials, but shortened the period of disqualification from running for office. The Court of Cassation is now reviewing the appeal and is expected to rule by early April.

By early April – that is, before the start of the actual presidential election campaign – France's Court of Cassation intends to rule on Le Pen's appeal. This leaves the legal sword of Damocles hanging over the entire election campaign.

The competition on the left has partly taken shape: Jean-Luc Mélenchon will run again as the candidate of the left-wing party La France Insoumise. In the other political camps, the candidates have not yet clearly lined up. The outcome of the appeal is therefore likely to significantly shape France's election year 2027.
