Life Imprisonment: Frankfurt Regional Court Convicts 60-Year-Old of Murdering His Wife

A life sentence in Germany means imprisonment for life. Early release is only possible after serving a minimum period of 15 years and requires a positive prognosis of fitness for detention. Possible Preventive Detention

In the specific case, the prosecution pointed out that the defendant had deliberately planned the staging as an accident.

In addition to the life sentence, the order of placement in preventive detention is also conceivable in the verdict if there is a danger of further serious crimes. The court must decide on this question separately. Until then, the convicted person remains in pretrial detention or in prison serving his sentence.

Further Proceedings

The verdict is not yet final. The defendant has the right, within one week after service of the judgment, to file an appeal on points of law (Revision) with the Federal Court of Justice (Bundesgerichtshof). Only after the expiry of the appeal period or a final decision by the BGH will the verdict become final.

The trial at the Frankfurt am Main Regional Court attracted nationwide attention because it stands as exemplary for cases in which the investigating authorities had to uncover a killing disguised as an accident. Detectives and the prosecution had worked on the case in close coordination with the crime scene investigation unit and the forensic medical institute.

Victim support organizations in Hesse point out, in such cases, the possibilities of psychosocial support during the proceedings and of joint plaintiffs (Nebenklage) for relatives. Family members of murder victims can join the proceedings as joint plaintiffs and file their own motions. These rights are also available in the present proceedings.
