Meta and 29 states settle lawsuit over alleged harms to children on Facebook and Instagram

What the settlement requires

California Attorney General Rob Bonta, whose office led the coalition of states, framed the outcome as a concrete change in how Meta operates its consumer platforms. "I am proud to deliver this settlement that addresses the concerns at the core of our lawsuit and institutes real change, real transparency, and real enforceable protections for children on Facebook and Instagram — right now, no more waiting," Bonta wrote in a statement announcing the deal.

The lawsuit was one of the highest-profile legal actions taken against a major social media company over the design of its products for young users. State attorneys general argued that Meta had failed to protect minors from mental health harms and had misrepresented the effectiveness of its safety tools, allegations that Meta has consistently disputed.

By settling before opening statements, both sides avoided the spectacle of a public jury trial that would have examined internal Meta documents and placed senior executives under oath. Investors reacted calmly to the news: Meta shares rose about 4 percent in pre-market trading on Wednesday.

Market reaction and open questions

The settlement does not include a public monetary penalty of the kind that some advocates had urged, and it leaves several questions unanswered, including how the independent auditor will be selected, how often reports will be made public, and what enforcement teeth the injunction will carry if Meta is found to have violated it.

Bonta's office said the agreement is intended to produce ongoing compliance rather than a one-time resolution. The independent monitor will have the ability to flag concerns directly to the attorneys general, giving state enforcers a continuing channel into Meta's product decisions affecting minors.

A wider push on child safety online

The 29-state coalition reflects a broader bipartisan shift in how U.S. states have approached child safety online. Lawmakers and regulators in both parties have pressed social media companies to verify users' ages, limit addictive design features and disclose how their algorithms treat minors.

For Meta, the settlement removes a significant legal cloud ahead of a year in which the company has invested heavily in artificial intelligence products and competes with other platforms for young users. The injunction, however, leaves the company exposed to further court action if regulators determine that future public statements about safety cross the line the settlement has now drawn.

Attorneys general have indicated they will monitor Meta's compliance closely and have not ruled out additional action if the company falls short. The deal also keeps the door open for the coalition to return to court to seek additional remedies, a step that Bonta's office said remained available under the terms of the agreement.
