The NEOS party is calling for a reform of criminal media law so that users of social networks will no longer be held liable by default for offensive comments made by third parties under their own posts.

Background: Liability for comments by others

The NEOS party is pushing for a change in the current media law because, under the current law, individuals can be held liable for offensive comments that others have left under their social media posts. Even those who have never seen such a comment can sometimes be confronted with lawsuits and high legal costs. According to NEOS, the costs per offensive comment can quickly reach up to 2,000 euros.

NEOS Justice spokesperson Sophie Wotschke announced that she would quickly initiate talks with coalition partners ÖVP and SPÖ to discuss possible solutions. Wotschke stated: "The goal is to place responsibility where it actually lies." NEOS sees a need for action because, in their assessment, the existing legal situation is not objectively justifiable.
