A former teacher stood trial again on Tuesday at the Regional Criminal Court in Graz after the Supreme Court of Justice (OGH) had overturned his original verdict due to a formal error. In the first proceeding, the man had been sentenced to two years and nine months in prison. The lay judges' court must now decide anew both on the severity of the sentence and on the question of committal to a forensic-therapeutic center.
Background: Annulment by the OGH
The public was excluded from the start of the trial at the request of the defense. The evidentiary proceedings are therefore taking place without an audience. A verdict was expected around midday. The public prosecutor's office stated on Tuesday that the lay judges' court must first clarify whether committal to a forensic-therapeutic center is legally permissible also with regard to the offense of extortion, and then decide on the severity of the sentence.
