Trial at Potsdam Regional Court: 77-year-old doctor charged with manslaughter in connection with assisted suicide of suicidal woman

The deceased was 39 years old. The investigating authorities have not provided further details regarding her specific health condition, possible pre-existing illnesses, or the extent of her suicidality. The names of the woman and the doctor have likewise not been made public by prosecutors. The trial is being held before the Grand Criminal Chamber of the Potsdam Regional Court.

According to the court, the defendant is a licensed physician and is 77 years old. He is alleged to have provided medical care to the woman over an extended period of time. Among other things, the evidentiary focus centers on whether the woman made her decision to take her own life freely and without external pressure, and whether the doctor had informed her of alternatives such as suicide prevention.

Legal framework since 2015

In Germany, the commercial promotion of suicide has been a criminal offense since a legislative amendment in 2015. To be distinguished from this is unpunished assistance with suicide, which remains permissible when it is not carried out commercially. According to criminal law scholars, the legal classification depends on whether a doctor acts repeatedly and in an organized manner or whether, in a given case, he or she acts out of compassion.

In the current proceedings, prosecutors accuse the doctor of having crossed a line. The public prosecutor's office classifies his actions as manslaughter because, according to expert opinion, the woman could possibly still have been saved. Whether a corresponding psychiatric expert opinion exists was initially unclear. The court has scheduled several hearing dates for the trial.

Should the court convict the defendant of manslaughter, he faces a prison sentence of five to 15 years. A conviction for killing on request would carry a significantly lesser penalty of up to five years. A termination of proceedings subject to conditions, such as a monetary penalty, is regarded as unlikely by procedural observers.

Running parallel to the criminal proceedings is a professional review by the responsible medical chamber. This concerns whether the physician violated his professional duties. Regardless of the outcome of the criminal trial, he could, in the most extreme case, have his medical license revoked.
