Against this backdrop, the prosecution of Bosnia and Herzegovina opened proceedings against Milorad Dodik, the president of Republika Srpska, as well as against other politicians of this para-state. They are accused of having approved, denied, grossly minimized, or attempted to justify genocide, crimes against humanity, and war crimes – precisely the acts for which Mladić was convicted.

According to the prosecution, the charges are directed against Dodik and several high-ranking officials of Republika Srpska. Public statements and political comments in connection with the death of the convicted man are being examined. According to the authority, the investigations are based on information from five independent sources.

International observers assess the move as a signal to those forces in Bosnia and Herzegovina that continue to trivialize the Srebrenica genocide. The prosecutor in charge pointed out that, under Bosnian law, the denial and trivialization of internationally prosecuted crimes constitute a separate criminal offense.

Proceedings against Dodik and Republika Srpska

The prosecution emphasized that the steps now initiated should be seen as independent of the ongoing political crisis surrounding Republika Srpska. Dodik himself had previously rejected the investigations as politically motivated. His SNSD party spoke of a pressure tactic from Sarajevo.

In parallel, the case continues to cause diplomatic tensions with Montenegro, which had authorized the transfer of the body through its airspace. The government in Podgorica defended the decision as a humanitarian gesture toward the deceased's family. Victims' associations in Bosnia and Herzegovina, on the other hand, are demanding clarification of the circumstances of the entire repatriation.

Human rights organizations such as the Humanitarian Law Center recalled that the judicial processing of the Yugoslav Wars is not yet complete. As long as high-ranking politicians publicly question the verdicts against war criminals, reconciliation in the region remains at risk, it was said.

Serbia is an EU accession candidate and has already been under observation by the EU Commission for years because of its stance on the prosecution of war crimes. The recent developments could further burden the already stalled accession process, as diplomats in Brussels indicated.

Diplomatic Tensions and EU Context

In Belgrade itself, the planned memorial service in the evening was cordoned off over a wide area by police. Eyewitnesses reported a small group of mourners at Nikola Tesla Airport. Official bodies did not publish a program for the subsequent burial.

Reactions from abroad remained restrained. Several European capitals expressed regret over the handling of the body of a convicted genocidaire and pointed to Serbia's obligations under international law.

Regardless of the further course of the proceedings against Dodik, observers see the dual development – the transfer of the body and the opening of the proceedings – as a litmus test for the region's handling of its recent past.

Mladić was convicted at first instance in 2017 and the conviction became final in 2021. He was considered one of the most wanted suspected war criminals in Europe before he was arrested in Serbia in 2011.
