The Federal Network Agency has ruled that Deutsche Bahn must in future allocate at least a quarter of its capacities on heavily utilized routes to competitors such as the Italian rail company Italo, which plans to enter the German long-distance market in 2028.

What the BNetzA has decided

The regulator's decision affects heavily utilized corridors with designated capacity ceilings, such as those planned for the Munich and Frankfurt hubs. Italo had previously filed a complaint with the Federal Network Agency about the way in which the already limited rail capacities in Germany are allocated. The company wanted to achieve improved framework conditions for new competitors. The Federal Network Agency is allowing the Italian rail company Italo access to the German long-distance network.
