The Advocate General at the Court of Justice of the European Union (CJEU), Campos Sánchez-Bordona, will on Thursday deliver his opinion in the infringement proceedings brought by Italy against Tyrol's anti-transit measures.
Italy brought the action because, from the Italian perspective, Austria unlawfully restricts the free movement of goods through the Tyrolean measures. Despite two CJEU convictions in 2005 and 2011, Austria has maintained unlawful restrictions on the free movement of goods and introduced further ones, the Italian side argued.
The Tyrolean anti-transit measures consist of a set of regulations intended to limit truck transit through the Austrian federal state of Tyrol. They include, among other things, sectoral driving bans, slot/dosage systems and nighttime driving bans on certain route sections. Italy considers these measures an impairment of cross-border trade, particularly along the Brenner corridor.
