Kickl announces constitutional law on "remigration" and sparks sharp criticism

The term "remigration" itself has been the subject of controversial debate for years. While supporters use the term as a political science description of a return policy, critics see it as a signal to far-right movements that have appropriated the term for their own purposes. Observers also point to the role of the AfD. Kickl has long been criticized with regard to the networking of the two parties, with the aim of forming a Europe-wide right-wing bloc. According to commentators, the announcement of a constitutional law in Vienna comes at a phase in which cooperation between the FPÖ and AfD has further consolidated at the parliamentary level.

Within the Austrian party landscape, it was primarily ÖVP representatives who expressed restraint or rejection. From circles of the People's Party, it was said that a constitutional law with this content would be hardly compatible with shared European values and Austrian constitutional tradition. An official statement from the ÖVP leadership was not available at the editorial deadline.

Constitutional hurdles

Constitutional law experts pointed out that a constitutional law in Austria requires a two-thirds majority in the National Council. The FPÖ does not currently have such a majority and would depend on votes from the ÖVP. This brings to the forefront the question of whether the People's Party would support such a project, and under what conditions it would be willing to do so.

Civil society organizations announced that they would monitor the project critically. They see in the use of the term "remigration" the danger of a normalization of positions that are observed by the domestic intelligence services. At the same time, they called for a broad public debate on the limits of migration policy measures.

Outlook for the coming weeks

In the coming weeks, Kickl is expected to further concretize the draft of the constitutional law. ORF moderator Simone Stribl had repeatedly followed up during the interview and pointed out contradictions between Kickl's statements and earlier FPÖ positions. Which deadlines Kickl will now set for the drafting initially remained open.

The German federal government and the EU Commission have not yet been quoted taking an official position. However, observers assume that the announcement will be noted attentively in Brussels, as comparable initiatives are underway in several EU member states and an Austrian constitutional law would raise issues of EU law.

Regardless of the legal assessment, the debate has already entered the beginning of the election campaign. The FPÖ is aggressively pushing the issue as a question of identity, while the other parties are forced to take a position. The constitutional law debate could thus become one of the defining domestic political conflicts in the further course of the year 2026.
