Mexico files complaints after deaths of migrants in ICE operations

Background: 17 deaths in connection with ICE operations

According to Mexican authorities, three of these deaths occurred during so-called deportation raids, and a further 14 in the immigration agency's detention facilities. The most recent fatal encounter took place on July 7 in Houston, where Mexican national Lorenzo Salgado Araujo was shot dead during a US immigration agency operation.

Human rights observers assess the Mexican step as an unusually direct legal confrontation between the two governments on a migration issue to date.

The Salgado Araujo case has triggered a broad debate in Mexico about the protection of migrants in the United States. President Sheinbaum had repeatedly described the circumstances of the deaths as unacceptable and demanded a comprehensive investigation. The call for an independent investigation is also supported by Mexican victims' associations.

Observers in Mexico City interpret the parallel lawsuits before state prosecutors and the US Department of Justice as an attempt to increase pressure on different legal levels. Criminal complaints at the state level could trigger different standards of evidence and procedures than a complaint at the federal level.

At the same time, legal experts point out that lawsuits against private operators could be easier to enforce under civil law than criminal investigations against federal officials. The contracts between the operators and the US government would offer starting points for civil liability questions.

The US immigration agency ICE has been under criticism for months over its deportation practices and conditions in its detention facilities. Mexican diplomats had repeatedly demanded consular access to arrested compatriots in recent weeks, citing the Vienna Convention on Consular Relations.

With the announced measures, Mexico is going a step further than in previous cases, where the government had limited itself to diplomatic protest notes. The combination of criminal complaints, civil lawsuits and consular initiatives points to a strategy that links migrant protection, law enforcement and foreign policy signaling.

Consular initiative and reactions in Mexico

The family of Salgado Araujo, who was killed in Houston, has since announced a civil lawsuit to be conducted independently of the Mexican federal government. Civil rights lawyers in Texas are reportedly examining possible claims regarding excessive use of force and insufficient investigation of the incident.

International organizations such as the Inter-American Commission on Human Rights have announced an observation of the case. Should the US authorities' account prove incomplete, this could also have implications for comparable incidents in other states in which Mexican migrants have died in ICE custody.
